Defending Taxpayers with Economic Hardship Rules

Presented by Lawrence Lawler, CPA, EA, CTRS (2 Hours)

Economic hardship is the Swiss Army Knife of tax problem resolution, it is mentioned hundreds of times in the Internal Revenue manual. Yet, many practitioners may not recognize how powerful a tool it is when representing a taxpayer before the IRS. After this presentation you will know when to contend economic hardship for your client. Some of the uses of economic hardship are found in cases involving CNC, non filers, innocent spouse, installment agreements, and more.

About Larry – Larry is the National Director of ASTPS and has represented literally thousands of taxpayers before the Internal Revenue Service and is a frequent public speaker, a writer on professional topics, and a regular trainer of tax professionals nationwide. He has become nationally recognized for his skills in solving tax problems, and has been a New York Certified Public Accountant since 1973. He is also a fellow of the NTPI and the managing partner of Lawler & Witkowski, CPAs, PC, the firm he established in 1973.

Defending Yourself from Taxpayers

Presented by LG Brooks, EA, CTRS (1 Hour)

Taxpayer representatives generally approach representation with the intent of doing everything possible to reduce taxes, eliminate penalties, and generally protect their clients from unwarranted IRS actions. Frequently a taxpayer arrives at the professional’s office with a certain amount of urgency due to the fact that they have neglected to act on IRS notices. Many practitioners react immediately and commence representing the taxpayer without a proper engagement letter. Engagement letters are critical in protecting your professional license and after this session you will understand:

About LG – LG is the Senior Tax Resolution Consultant at Lawler and Witkowski CPA’s. LG has been in the field of taxation for more than 30 years and has been in practice full time since 1990. LG has represented and consulted on thousands of cases and he specializes in resolving high dollar, complex, tax problems all over the country. LG received a Bachelor of Arts degree from Bishop College at Dallas, Texas in 1977.

Defending the Innocent Spouse

Presented by Veronica Marelli, EA, CTRS (1 Hour)

IRC 6015 is a powerful tool often overlooked in representation cases. After this session you will be familiar with the many new opportunities to protect the taxpayer as well as the new rules related to innocent spouse cases. Veronica will explore real life scenarios and provide an update for changes made by the Taxpayer First Act.

By the end of this course you will understand:

  • New deadlines for Equitable relief rules you need to know
  • Procedures for relief from liability applicable to all joint filers
  • Procedures to limit liability for taxpayers no longer married or taxpayers legally separated
  • When the tax court has jurisdiction for innocent spouse cases
  • What issues a practitioner needs to consider when a tax prep clients wants you to you to represent them in an innocent spouse case
  • Can you represent one former spouse in an innocent spouse request for relief and the other former spouse in an OIC?

Defending Taxpayers Means Helping Them Make the Right Decisions 

Presented by Steven Klitzner, Esq., CTRS (2 Hours)

Decisions, Decisions, Decisions – The IRS wants to speak to your client. What do you recommend? The IRS wants your client to extend the Assessment Status of Limitations on an audit. What do you do? Your client has the right to request a Collection Due Process or Equivalent Hearing. Which do you choose? There are best practices and there are exceptions to every rule. Knowing the reasoning that guides collection and audit case decisions is critical to the professional as the architect of the taxpayer’s defense plan. Miami Tax Attorney Steve Klitzner will illustrate how to examine the facts and circumstances to make the best decisions on your tax resolution cases. Steve will take you step by step through the tools and strategies to get the best results for your clients

Steve has presented at many ASTPS conferences in the past and is the newest member of the Boot Camp Training Team. He is admitted to the United States Supreme Court, United States Tax Court, United States Court of Appeals for the Fifth Circuit, and the United States District Court for the Southern District of Florida. He currently sits on the IRS Advisory Council, and is a frequent lecturer on Tax Resolution topics and has presented to thousands of practitioners around the country. He is well known for the humor he brings to his presentations!
